GENERAL TERMS AND CONDITIONS



The general terms and conditions mentioned here apply to all of the transactions made at www.footlux.com, property of Footlux Moda y Calzado, S.L. (Footlux) , a legally constituted company in Spain CIF: B84391556 and registered in the Trade Register of Madrid (volume 21.577-book 0- sheet 25-section 8-page M-383927).

Footlux’s headquarters are located in Spain at C/ Duero, 3, Nave B2, Polígono La Raya, PAE Madrid Este 1, 28816, Camarma de Esteruelas. Madrid.
The use and access of Footlux, is regulated by the general terms and conditions of use and sale here mentioned. The access to this web site, its use and the purchasing of items at www.footlux.com assumes the reading, the understanding and the acceptance of the following general terms and conditions.

If you want to know more about legal details, please consult our privacy policy and return policy sections. You can also visit our HELP area, where you can find additional information about orders, deliveries, refunds and returns of items acquired at Footlux.com and other relevant information.

Footlux may, from time to time, modify or actualize the general terms and conditions mentioned, in consideration of new laws and regulations. Each new version of the general terms and conditions will become effective the same day Footlux.com publishes them on the web site. Please review often this general terms and conditions. If you do not agree with the changes made to the general terms and conditions, you should stop using this web site.

To be able to use some of our services and features made available to you in our web site, you will need to register. Changes could be made to the information we require at registration.
When you register, we will ask you for some personal information which must be accurate, true, up to date and complete in all aspects. Should any of your registration information change, please make those changes in MY ACCOUNT.

Remember that you will be liable for your use of Footlux.com and its contents. You agree that you will be personally responsible for your use of this Site and for all of your communication and activity on this Site. We reserve the right to deny you access to this Site, or any part of this Site, at any time without notice. If we determine, in our sole discretion, that you engaged in prohibited activities, were not respectful of other users, or otherwise violated the general terms and conditions, we may deny you access to this Site on a temporary or permanent basis and any decision to do so is final.

In particular, you will be liable for communicating information or data which is not correct, false or concerns third parties (in the event such third parties have not given their consent), as well as for any improper use of such data or information.


1. GENERAL TERMS AND CONDITIONS OF SALES


  • Footlux offers the sale of its products through www.footlux.com to the final consumers.
This Site is for your personal, non-commercial use only. A final consumer is any person that shops at Footlux.com with different aims which are not commercial or professional activities. Footlux will not take any order that is not made by a final consumer.
  • Footlux reserves the right to modify its commercial offer in the web site at any time (modifications of the prices, products, promotions, and other commercial and service conditions). These modifications will not affect at any time the purchases that have already been made.
  • The prices shown on this web site for the European Union have their corresponding VAT included. The prices shown on this web site for countries outside of the European Union do not include VAT. When you receive your order, you will be responsible for the payment of any taxes and duties generated at customs. You can contact your local customs office to request the details of these charges.
If you decide to refuse any shipments from footlux.com, you will be responsible for the original shipping costs and any duties, taxes and/or customs charges that are incurred on the package, and the cost of returning the package to Footlux.com. This amount will be subtracted from your merchandise refund.
We are required by law to disclose the full value of the package contents and cannot alter this value.
  • Closing a contract with Footlux
    • To make a purchase you must place your favourite items inside the “shopping bag” and follow the steps that are defined on the web site. To close a sale contract with Footlux you must fill out the electronic order form and submit it following all the steps.
    • Throughout the order form you will have access to our general terms and conditions, the return policy, privacy policy, price and description of the products you have chosen, shipping costs and methods.
    • After receiving your order form, your contract with Footlux will be closed once we have obtained authorisation for payment.
    • Before submitting your order, we recommend that you read the general terms and conditions. Please, check all your data is correct before submitting it.
    • Once you have made your choice and your order has been placed, you will receive an email acknowledging the details of your order and your order number. We recommend that you print this page, so that in the unlikely event that you do not receive this e-mail you have your order number and confirmation.
    • Footlux may not process purchase orders that do not give sufficient guarantees of solvency, or that are incomplete or incorrect, or orders for products that are no longer available. In the above cases, we shall inform you by e-mail that your order has not been processed specifying the reasons thereof.
If the problem is detected when the order has already been transmitted and paid, we will send you a refund.
    • By sending your order form you are accepting all the general terms and conditions, the private policy, the return policy and all the contents in Footlux. If you have any doubts or you do not agree with this text please do not send the order form.


At Footlux.com, we offer luxury and top-quality products. These products are purchased by Footlux.com directly from manufacturers and carefully selected by stringent quality controls.
Footlux.com does not sell second-hand products, flawed products or products of lower quality as compared to the corresponding standards offered on the market.
The main characteristics of products are shown on Footlux.com inside each product schedule. The products offered on Footlux.com may not exactly correspond to the real garments in terms of image and colors because of the Internet browser or of the monitor used.

1.1 Methods of payment

When filling out the order form, you may be able to choose from different payment methods depending on your home country. We have cash on delivery available for some countries.
If you choose credit/debit card, credit card details are entered directly into our payment partner’s system and are neither transmitted nor held on Footlux.com systems.

This information will only be used by Footlux to complete the order process, make a refund if a return is made or inform the police in case any fraudulent activity against Footlux is detected.

1.2 Shipping methods and costs

Footlux ships all orders through the international currier UPS. You can find more information about our shipping methods, costs and dates of delivery in the subsections deliveries and returns and delivery charges inside the HELP area.

1.3 Customer Care

For further information on making a claim or if there has been any incident with your order, please contact us by writing an e-mail to customercare@footlux.com or fill out the form you will find in the Customer Care area. You can also contact us by calling +34 91 886 63 83 Monday to Friday, from 9am to 6 pm.

1.4 Return Policy

In Footlux.com we care about customer satisfaction. If for any reason you are not totally satisfied with your purchase, or the item you have purchased is not your size, you have the right to return it within 10 working days from the date that you have received your order.

To return an order you must first send an e-mail to returns@footlux.com within these 10 working days to receive a mandatory return number. This mandatory return number must be included when filling out the return form. You will find this form inside the box where you received your order.

Footlux offers a free return process when using our international courier UPS.
Once you have received your mandatory return number, Footlux will contact UPS to pick up the item that you want to return at the same mailing address where the merchandise was delivered. The merchandise can be picked up at another address in the same city only if this address has been clearly specified in the previous e-mail, sent to returns@footlux.com.

Alternatively, should you wish to use your own courier company, the return address is as follows:

Please note that we do not accept liability for returned goods if you do not return them to us via UPS. We would not accept any cash on deliveries nor will be responsible for any shipping cost nor any duties, taxes and/or customs charges that are incurred on the package if the return is not sent to us via UPS.
*Please note that if you want to use your own courrier company, you should inform us in advance when requesting your mandatory return number.

In both cases, you must previously obtain a mandatory return number and your return package should be sent within 5 working days after obtaining this number. The package must arrive at Footlux within 30 working days of the date you received your order.

Returns received outside the above time frames are accepted at the discretion of Footlux.com and can only be refunded as LuxCredit.

Your right to withdraw is subject to the following conditions:

- You must contact returns@footlux.com to obtain a mandatory return number and inform us of the items you want to return.
- You must fill out the return form inside the original package and include it with your return.
- The items must be in perfect condition, neither used nor damaged.
- The items must include the identification label attached to them.
- The items must be returned in their original box.
- The returned items must be sent to Footlux in one shipment. Footlux reserves the right not to accept returned products belonging to a single order that are returned at different times.

Your return order must fulfil all of these conditions in order to be accepted.
In case your return does not meet this conditions Footlux will contact you to offer the option of returning back to you the items that have not been accepted.
Please be aware that you will be responsible for any additional shipping, taxes and import duties if return conditions have not been complied and we send you back your faulty return. If you do not accept this option, Footlux.com will keep the items and do not refund them.

After Footlux.com has received your returned goods and checked that all requirements are met, you will receive an e-mail confirming the acceptance of your returned items.

Refunds to you will be made within 30 working days of the date of cancellation notice, which is to say from when the return is accepted. All undamaged, correctly returned products will be credited to the original purchaser´s credit card including sales taxes for all EU country shipments excluding shipping charges. As previously stated, international customs duties and sales taxes are non- refundable for shipments outside the European Community (EU).
Remember that we don’t refund delivery costs, only the amount paid for the item you have decided to return.
Delivery costs will only be refunded if the causes of the return can be attributed to Footlux, for example, if the item that you received was not the one you ordered or if the item you have received is damaged.

You will receive your reimbursement in the same payment method you used to pay the items you are returning.
    • Credit/debit card: Time needed for reimbursement depends on your banking institution, because they may require additional days to process and post this transaction to your account once they have received the information from Footlux.com, but normally it occurs within two statements.
Be aware that the credit date of the refund will be the same as the debit date so you will not suffer any bank interest loss.
    • Reimbursement on your account: If you had the option to pay cash on delivery in your country, your refund will be made in your bank account.
Normally it occurs within a month from when we have your bank account information.
    • If you are returning a gift, the refund will be made to the individual who made the purchase.

1.5 Security and Confidentiality

Footlux guarantees the security and confidentiality in all communications made with its customers.
Payment operations are made through a secure server, based on the standard SSL, which protects data from attempts of violation from third parties.
Footlux guarantees the protection and confidentiality of personal and payment information and other data provided by our users as established in the Spanish Organic Law 15/1999, 13th of December on the Personal Data Protection.

In accordance with the provisions set at the Spanish Organic Law 15/1999 of 13th December on Personal Data Protection, you may at all times exercise your right of access, rectification, cancellation and opposition on your personal data, communicating so by writing to Footlux Moda y Calzado, S.L., Av. Emilo Arrieta, 5, Pt. 4, 28706 San Sebastián de los Reyes, or sending an e-mail to info@footlux.com.

1.6 Governing law - jurisdiction

All transactions made with Footlux Moda y Calzado, S.L., will be submitted to Spanish legislation.
In case of conflict or discrepancy the applicable law will be at the courts of Madrid (Spain) as long as there is no legal disposition against it.

You acknowledge and agree that all copyright, designs, trademarks and all other intellectual property and material rights relating to the Content as herein described, including Footlux Software and all HTML and other code contained in this Site, shall remain at all times vested in Footlux and/or are the property of their respective owners. All such Content, including third party trademarks, designs and related intellectual property rights mentioned or displayed on this Site are protected by national intellectual property and other laws and international treaty provisions. You are permitted to use the Content only as expressly authorised by Footlux and/or its third party licensors. Any reproduction or redistribution of the above listed Content is prohibited and may result in civil and criminal penalties. Violators will be prosecuted to the fullest extent permissible under applicable law. Without limiting the foregoing, copying and use of the above listed materials to any other server, location or support for publication, reproduction or distribution is expressly prohibited.

Footlux tries to ensure that the information on this site is accurate and complete. Footlux does not warrant or represent that Contents at Footlux.com are accurate, error-free or reliable or that your use of it will not infringe rights of third parties. Your use of the Web Site is at your risk.
